Los Gatos Asphalt Paving Company provides asphalt paving, sealcoating, repair, striping, and related pavement services to residential and commercial customers inLos Gatos, CA and surrounding communities. Services are performed by or under the supervision of licensed and insured contractors. The specific scope of work for each project is defined in a written proposal or estimate provided to the customer before work begins.
All estimates provided by Los Gatos Asphalt Paving Company are free and carry no obligation. Estimates are based on information available at the time of the site visit and are valid for 30 days from the date of issue unless otherwise stated.
Prices are subject to change if the scope of work changes, if site conditions differ materially from what was observed during the estimate, or if material costs change significantly between the estimate date and the scheduled work date. Any changes to the agreed scope of work will be communicated to the customer in writing before additional work is performed.
A written proposal must be accepted by the customer before work begins. Verbal agreements alone do not constitute a binding contract for services.
We will make every reasonable effort to complete work on the scheduled date. However, scheduling is subject to change due to weather conditions, equipment availability, or unforeseen circumstances. We will notify customers as early as possible if a scheduled date must change.
Customers who need to cancel or reschedule a confirmed appointment should contact us at least 24 hours in advance. Cancellations made with less than 24 hours notice may result in a service call fee to cover mobilization costs, if crews have already been dispatched.
We reserve the right to reschedule work if site access is blocked, surfaces are wet, or weather conditions would compromise the quality of the installation.
Payment terms will be specified in the written proposal for each project. In general, payment is due upon completion of the work unless other arrangements have been made in writing in advance.
For larger commercial projects, a deposit may be required before work begins. Deposit amounts and payment schedules will be outlined in the project proposal.
Invoices not paid within the agreed timeframe may be subject to a late fee. If collection efforts are required, the customer may be responsible for reasonable collection costs, including attorney fees, to the extent permitted by applicable law.
Los Gatos Asphalt Paving Company stands behind the quality of its work. The specific warranty terms for each service type will be stated in the written proposal. In general, we warrant that our work will be free from defects in workmanship for the period specified in your proposal, subject to the following conditions:
Material warranties, if any, are provided by the material manufacturer and not by Los Gatos Asphalt Paving Company.
To the fullest extent permitted by applicable law, Los Gatos Asphalt Paving Company shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the services provided or the use of this Site, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from a specific project shall not exceed the total amount paid by you for that project.
The information and content on this Site are provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be error-free, uninterrupted, or free of viruses or other harmful components. The foregoing does not affect any service warranties expressly provided in a signed project proposal.

If a dispute arises between you and Los Gatos Asphalt Paving Company relating to these Terms or services performed, we encourage you to contact us first at sales@losgatosasphaltpavingcompany.com so we can try to resolve the matter informally.
If informal resolution is not possible, any dispute shall be resolved through binding arbitration in Los Gatos, CA, under the rules of the American Arbitration Association. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Santa Clara County, California.
We reserve the right to modify these Terms and Conditions at any time. When we do, we will update the effective date at the top of this page. Continued use of this Site or continued engagement of our services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
